CONSULTING CONTRACT
This Consulting Contract ("Contract") is made and entered into to be effective as of
today's date,
by and between: BCR Consulting, a Texas company whose primary business office is located at
1609 Shoal Creek Blvd, Suite 100, Austin, TX 78701 ("BCR Consulting," "We," "Us," or "Our")
and your full name,
an individual whose primary residence is located at
your address
("Client," "You," "Your," or "Yours").
1. Service Description
You have engaged BCR Consulting to perform credit repair services and We agree to perform services that include setting up Your account, collecting information from You, reviewing Your credit reports, auditing negative items in Your credit reports and consulting with You to identify inaccurate, incomplete or obsolete information in Your credit report and preparing and mailing disputes or other letters on Your behalf and in Your name to the credit bureaus, as well as preparing and mailing debt validation or other letters on Your behalf and in Your name to collectors, creditors, or others, and other systematic disputes and legal challenges to credit bureaus and creditors for trade lines you identify as outdated, misleading or inaccurate. The consulting services will also include recommendations from BCR Consulting on steps You can take to improve Your credit standing, obtain new credit and reduce Your debt.
2. Service Fees
a. You agree to pay BCR Consulting $139.00 immediately upon notice that the initial Services are complete.
b. There will be no charge for the first two items deleted. Then You agree to pay BCR Consulting $39.00 per derogatory item deleted per bureau and $75.00 per public record deleted per bureau (such as Bankruptcies, Tax Liens, Judgments, Child Support and Foreclosures). There will be no charge for removing personal information such as incorrect spellings of names, addresses and social security number variations.
c. BCR Consulting will advise You on how to obtain free copies of Your credit reports from Equifax, Experian and TransUnion at no additional cost to You.
d. Consulting services will be provided over approximately 180 days. You are required to maintain a three-bureau credit monitoring service providing updated reports every 30 days for the duration of this contract (six months from the effective date).
e. You agree to pay BCR Consulting the amount due every month within seven (7) business days from the invoice date. Failure to make on-time payments will result in the immediate release of BCR Consulting from any obligations under this contract.
3. Power of Attorney
You hereby appoint BCR Consulting and each of its employees, agents and contractors as Your agent and attorney in fact for the limited purpose of communicating with the credit reporting agencies, government agencies and creditors in order to challenge any inaccurate, erroneous, and obsolete information in Your credit files. This power of attorney is coupled with interest and shall survive Your incapacity, disability or death. This power of attorney shall constitute authorization to obtain Your credit information for purposes of section 611 of the Federal Fair Credit Reporting Act.
4. Your Obligations
You recognize that although You are receiving consulting services from BCR Consulting, You will be ultimately responsible for improving Your own credit status. You agree to:
- Provide BCR Consulting with copies of all correspondence received from Credit Reporting Agencies, Creditors, Collection agencies, Attorney General Offices, Better Business Bureau, Federal Trade Commission and Comptroller of the Currency within ten (10) business days.
- Make all scheduled payments on Your debts on or before the due dates.
- Notify BCR Consulting of any change of address or contact information within three (3) business days. You agree not to incur any new debt or obtain any new credit cards without prior written notice to BCR Consulting.
- Refrain from contacting credit bureaus or creditors directly concerning your collection accounts, unless directed to do so by BCR Consulting.
- Pay within seven (7) days the invoice that BCR Consulting sends when results are obtained.
5. Cancellation
You shall have the right to terminate this Contract at any time on written notice to BCR Consulting. Cancellation is effective when all of the following conditions are satisfied: (a) Your Notice of Termination is received at BCR Consulting's office; (b) You forward an updated three-bureau credit report (failure to do so within seven days results in a fee of $39.00 per disputed item); and (c) You have complied with all obligations under this Contract.
6. Warranty
If any item deleted or corrected is re-listed in its original form while this contract is in effect or after — provided You have complied with all obligations — BCR Consulting shall attempt to correct or remove that item again at no charge. If unable to do so within ninety (90) days, BCR Consulting shall issue a refund for the amount previously paid for that item.
7. Choice of Law and Miscellaneous
This Contract shall be governed and construed in accordance with the laws of the state of Texas. It constitutes the entire agreement between the parties and replaces any prior agreement. If any provision is found to be illegal, invalid or unenforceable, the remaining provisions remain in full force and effect.
Special Rights of Cancellation
YOU, THE CLIENT, MAY CANCEL THIS CONTRACT AT ANY TIME BEFORE MIDNIGHT OF THE THIRD DAY AFTER THE EFFECTIVE DATE.
